1. Acceptance of Terms

By accessing or using autosender.lol ("the Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Service Description

autosender.lol is a message scheduling and automation service that allows users to schedule and send messages to Discord channels at specified intervals. The Service operates by using Discord user tokens provided by you to send messages on your behalf.

3. Discord Terms of Service - CRITICAL WARNING

YOU ACKNOWLEDGE AND AGREE THAT:

• Automated messaging using user tokens violates Discord's Terms of Service.
• Discord explicitly prohibits the use of self-bots and automated user accounts.
• Using this Service WILL LIKELY result in your Discord account being suspended, banned, or permanently terminated by Discord.
• You are solely and exclusively responsible for any and all consequences resulting from your use of this Service, including but not limited to account termination, loss of access, loss of data, server bans, or legal action by Discord.
• We provide this Service for educational and experimental purposes only.
• You assume all risks associated with using this Service.

WE ARE NOT RESPONSIBLE FOR ANY DISCORD ACCOUNT ACTIONS, BANS, TERMINATIONS, DATA LOSS, OR ANY OTHER CONSEQUENCES RESULTING FROM YOUR USE OF THIS SERVICE.

By using this Service, you explicitly accept all risks associated with automated Discord messaging and acknowledge that you have been clearly and repeatedly warned about Discord's Terms of Service. You further acknowledge that no amount of security measures can guarantee that Discord will not detect and ban your account.

4. Your Responsibilities

4.1 Account Security

You agree to:

• Use a dedicated automation Discord account, not your primary personal account
• Enable two-factor authentication (2FA) on any Discord accounts used with the Service
• Keep your Discord tokens secure and never share them with others
• Maintain the security of your autosender.lol account credentials
• Immediately notify us of any unauthorized access to your account
• Understand that you are solely responsible for the security and use of your Discord tokens

4.2 Lawful Use

You agree NOT to use the Service to:

• Send spam, unsolicited messages, or harassing content
• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Distribute malware, viruses, or malicious content
• Impersonate others or misrepresent your affiliation
• Engage in any fraudulent or deceptive practices
• Send messages to servers where you do not have permission
• Violate the rules or terms of any Discord server

4.3 Content Responsibility

You are solely responsible for all content you send through the Service. We do not monitor, review, or control the content of your messages. You represent and warrant that you have all necessary rights to send the content you provide to the Service.

5. Our Security Measures

While we cannot guarantee complete security, we implement the following measures to protect your data:

• Token Encryption: Discord tokens are encrypted at rest using AES-256-CBC encryption with random initialization vectors.
• Rate Limit Protection: Our system automatically respects Discord's rate limits, slowmode restrictions, and global rate limits to minimize the risk of token detection and flagging.
• Secure Storage: All sensitive data is stored in encrypted databases with role-based access controls and connection security.
• Error Handling: Campaigns automatically stop when critical errors are detected, invalid tokens are encountered, or when Discord returns error responses indicating account issues.
• Environment Security: Encryption keys and sensitive configuration are stored in secure environment variables, separate from the database.

Despite these measures, you acknowledge that no system is completely secure and that using automated Discord messaging carries inherent risks. You use the Service entirely at your own risk.

6. Payment, Subscriptions, and Usage Limits

6.1 Payment Method

Payments are processed through Sellauth. You must purchase subscriptions before using the Service. We do not handle payment card information directly - all payment processing is conducted through Sellauth's secure payment system.

6.2 Subscription Plans

We offer subscription-based pricing plans with varying durations (monthly or yearly). When you purchase a subscription:

• Daily message limits are granted upfront for the entire subscription period
• Daily limits become available according to the schedule defined by your subscription plan
• Each billing period has its own daily limit allocation that resets at the end of that period
• Active subscriptions remain valid until their expiration date

6.3 Usage Limits System

Our Service operates with daily message limits:

• Each subscription plan has a daily message limit that resets every 24 hours
• Messages are counted towards your daily limit only after successful delivery to Discord
• Failed messages due to rate limits, slowmode, invalid channels, or network errors do not count towards your daily limit
• Your daily limit is checked before attempting to send messages
• If you reach your daily limit, your campaigns will automatically stop until the next day
• Daily limits reset at midnight UTC according to your subscription plan
• Unused daily limit allowances do not carry over between days
• Daily limits are non-refundable once messages have been successfully delivered

6.4 Free Plan

We offer a free plan with limited daily message limits. Free plan daily limits:

• Are automatically granted each day
• Reset at the end of each calendar day
• Do not carry over to the next day
• May include promotional signatures or branding in messages

6.5 Refunds

Subscription fees are generally non-refundable. However, we may provide refunds at our sole discretion on a case-by-case basis for:

• Service outages or technical issues that prevent normal operation
• Billing errors or duplicate charges
• Account termination due to our error

Messages sent within your daily limits are not refundable under any circumstances. Refund requests must be submitted through our Discord support within 14 days of the transaction.

6.6 Subscription Management

Subscriptions are purchased for a fixed term (e.g., 1 month, 1 year). Subscriptions do not automatically renew - you must manually purchase a new subscription when your current one expires. When a subscription expires:

• Your daily message limits reset to the free plan levels
• Your account reverts to the free plan
• Running campaigns will stop if they exceed the free plan daily limits

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We reserve the right to:

• Modify, suspend, or discontinue the Service at any time
• Perform maintenance that may temporarily affect availability
• Implement usage limits or restrictions

We are not liable for any downtime, data loss, or inability to access the Service.

8. Account Termination

8.1 Termination by Us

We reserve the absolute right to suspend, restrict, or terminate your account and access to the Service immediately, with or without prior notice, for any reason or no reason, including but not limited to:

• Violation of these Terms of Service
• Violation of applicable laws, regulations, or third-party rights
• Illegal activity, fraud, or abuse of the Service
• Non-payment of fees or chargebacks
• Suspicious or unusual account activity
• Reports or complaints from Discord or other users
• Actions that may expose us to legal liability
• Any reason at our sole and absolute discretion

8.2 Effects of Termination

Upon termination or suspension of your account:

• Your access to the Service will immediately cease
• All running campaigns will be stopped
• We may, at our sole discretion, delete your account data, including campaigns, messages, and settings
• You will not be entitled to any refund of subscription fees or payments
• Your Discord tokens will be deleted from our systems

8.3 Termination by You

You may terminate your account at any time by ceasing to use the Service and requesting account deletion through our Discord support. Account deletion is permanent and cannot be undone. Termination by you does not entitle you to any refund of fees.

9. Intellectual Property

The Service, including all software, designs, text, graphics, and other content, is owned by us or our licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

You retain ownership of the content you create and send through the Service. By using the Service, you grant us a limited license to store, process, and transmit your content solely for the purpose of providing the Service.

10. Disclaimers and Limitation of Liability

10.1 No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, SECURITY, OR RELIABILITY.

We explicitly do not warrant that:

• The Service will be error-free, secure, uninterrupted, or available at any time
• Messages will be delivered successfully or at all
• Your Discord account will not be banned, suspended, or terminated
• The Service will meet your specific requirements or expectations
• Any errors, defects, or security vulnerabilities will be corrected
• Your data will be secure or free from unauthorized access
• The Service complies with Discord's Terms of Service (it explicitly does not)
• Discord will not detect or prevent the Service from functioning

YOU EXPRESSLY ACKNOWLEDGE THAT USE OF THIS SERVICE IS LIKELY TO RESULT IN DISCORD ACCOUNT TERMINATION.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, business opportunities, goodwill, or reputation
• Loss of data, content, messages, or any other information
• Discord account suspension, termination, permanent banning, or any enforcement actions
• Inability to use the Service or Discord
• Any third-party actions, claims, or enforcement actions, including by Discord
• Unauthorized access to or alteration of your data or Discord tokens
• Service interruptions, downtime, or unavailability
• Security breaches, data leaks, or unauthorized disclosures
• Any reliance on the Service for critical or business purposes
• Any damages resulting from changes to Discord's platform, API, or enforcement policies

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE, REGARDLESS OF THE FORM OF ACTION (WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR $100 USD, WHICHEVER IS LESS.

This limitation of liability is a fundamental element of the basis of the bargain between you and autosender.lol. The Service would not be provided without such limitations.

10.3 Indemnification

You agree to indemnify, defend, and hold completely harmless autosender.lol, its owners, operators, employees, contractors, affiliates, licensors, and service providers from and against any and all claims, damages, losses, costs, liabilities, and expenses (including but not limited to reasonable attorneys' fees, court costs, and expert fees) arising from or related to:

• Your use or misuse of the Service
• Your violation of these Terms of Service
• Your violation of Discord's Terms of Service, Community Guidelines, or other policies
• Content you create, transmit, or send through the Service
• Your Discord tokens, accounts, or credentials
• Any third-party claims, demands, or legal actions related to your Service
• Your violation of any law, regulation, or the rights of any third party
• Any damages, losses, or harm caused to Discord, other users, or third parties
• Any dispute between you and Discord or any other user

This indemnification obligation will survive termination of these Terms and your use of the Service. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate fully with our defense of such claims.

11. Third-Party Services

The Service integrates with and depends on Discord. By using our Service:

• Discord Platform: You must comply with Discord's Terms of Service and Community Guidelines. We send messages to Discord using your provided tokens, and Sellauth processes payments for subscriptions.
• Sellauth Payments: All payment processing is handled through Sellauth's secure payment system. Payment disputes must be resolved through Sellauth's payment support.

We are not responsible for Discord's actions, policies, downtime, or changes to their platform. Your use of Discord is subject to Discord's terms and policies. We have no control over Discord's enforcement actions against user accounts.

12. Data and Privacy

Our collection, use, and protection of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

14.2 Jurisdiction

You agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the competent courts of Sweden. You hereby irrevocably consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

14.3 Dispute Resolution

Before initiating any legal proceeding, you agree to first contact us through our Discord support to attempt to resolve the dispute informally. If the dispute cannot be resolved informally within 30 days, you may pursue legal remedies in accordance with the jurisdiction provisions above.

14.4 Time Limitation

You agree that any claim or cause of action arising out of or related to the Service or these Terms must be filed within one (1) year after such claim or cause of action arose, or be forever barred, regardless of any statute or law to the contrary.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and autosender.lol regarding the Service and supersede all prior agreements, understandings, representations, and warranties, whether written or oral, relating to the subject matter hereof.
